경기도의회 여성가족평생교육위원회 최효숙 의원(더불어민주당, 비례)이 대표발의한 ‘경기도 외국인주민 지원 조례 일부개정조례안’이 지난 4월 21일 상임위원회 심사를 통과했다.

이번 개정안은 외국인 아동에 대한 지원 기준을 완화해 입국 초기 단계부터 교육·보건·복지 서비스를 받을 수 있도록 한 것이 핵심이다.

현행 조례는 ‘경기도 내 90일 초과 거주’ 요건을 충족해야 지원이 가능해, 입국 초기 외국인 아동이 각종 공공서비스에서 배제되는 사각지대가 지적돼 왔다.

이에 개정안은 ‘18세 미만 아동’에 한해 거주 기간 요건을 적용하지 않는 예외 규정(제5조 제3항)을 신설해, 초기 정착 단계부터 공백 없는 지원이 가능하도록 했다.

최효숙 의원은 “부모를 따라 입국한 외국인 아동에게 초기 적응 지원은 필수적임에도 제도적 한계로 지원받지 못하는 사례가 있었다”며 “이번 개정을 통해 차별 없는 보편적 서비스 제공과 포용적 복지 환경 조성의 전환점이 될 것으로 기대한다”고 밝혔다.

이어 “조례 개정을 계기로 외국인 아동 지원체계가 보다 촘촘해지길 바란다”며 “지역사회 안정적 정착에도 실질적인 도움이 될 것”이라고 덧붙였다.

한편 해당 조례안은 오는 30일 본회의 의결을 거쳐 최종 확정될 예정이다.

Ordinance Bill to Relax Residency Period Restrictions Passes Standing Committee… Support for Initial Adaptation Expanded

The "Partial Amendment to the Gyeonggi Province Ordinance on Support for Foreign Residents," proposed by Representative Choi Hyo-sook (Democratic Party of Korea, Proportional Representation) of the Gyeonggi Provincial Assembly's Women, Family, and Lifelong Education Committee, passed the standing committee review on April 21.

The core of this amendment is to relax support criteria for foreign children, allowing them to receive education, health, and welfare services from the initial stages of their entry into the country.

Under the current ordinance, support is only available if the requirement of "residing in Gyeonggi Province for more than 90 days" is met; this has led to criticism regarding blind spots where foreign children are excluded from various public services during the initial period of entry.

In response, the amendment establishes a new exception clause (Article 5, Paragraph 3) exempting "children under the age of 18" from the residency period requirement, thereby enabling uninterrupted support from the initial settlement stage. Council Member Choi Hyo-sook stated, “Although initial adaptation support is essential for foreign children who entered the country with their parents, there have been cases where they were unable to receive it due to institutional limitations.” She added, “I expect this amendment to serve as a turning point for providing universal services without discrimination and creating an inclusive welfare environment.”

She continued, “I hope that this ordinance revision will lead to a more comprehensive support system for foreign children,” and added, “It will also provide practical assistance for their stable settlement in the local community.”

Meanwhile, the ordinance bill is scheduled to be finalized following a vote at the plenary session on the 30th.
