아이에스동서가 시공한 안양아이에스비즈타워 B동 스프링클러 동파로 입주해 있던 와인숍에 2억대의 피해가 발생했으나 아이에스동서는 하자보수도 제대로 하지 않고, 피해복구도 해주지 않고 ‘법대로 소송을 제기하라’는 식으로 대응하고 있어 사회적 물의를 빚고 있다.
지난해 12월 25일 오후 1시 38분 안양아이에스비즈타워 B동 205호에 입주해 있는 와인숍 ‘비니더스샵 코리아(대표이사 전재완, 부대표 이정희, 이하 비니더스샵)’에 때 아닌 물난리가 났다. 5미터 높이의 천장에 배관돼 있는 스프링클러가 동파돼 쏟아져 내린 물로 와인숍은 사람 발목까지 물에 잠겨 바닥과 거치대에 진열된 와인, 사무기기, 가구 및 인테리어 등에 2억 원대의 손실이 발생하고, 안양아이에스비즈타워 B동 2층 전체가 물에 잠겼다. ‘비니더스샵 코리아’로부터 20미터 거리에 있는 건물 엘리베이터까지 물이 흘러가 건물 관리실에서는 감전의 위험을 대비해 엘리베이터 8기를 전부 작동 중지시켰다. 물은 순식간에 안양아이에스비즈타워 B동 205호(비니더스샵), 206호(문구점), 207호(최고당돈까스), 208~209호(영어학원), 2층 공용엘리베이트 8대, 2층 복도 바닥 전체, 1층 복도 일부까지 번졌다.
와인숍에 피해가 가장 크게 발생했고, 10명이 동원돼 와인숍의 물을 퍼내는데 두 시간 반이 걸렸다. 뺀 물은 공용화장실 수조를 통해 흘려보냈다.
비니더스샵의 연락을 받고 이튿날 시공사인 아이에스동서 S차장을 포함 직원 3명이 와인숍을 방문, “누수의 원인이 천장 내부의 스프링클러가 동파됐기 때문이며, 동파의 원인은 방화구획인데도 마감처리를 제대로 하지 않아 외부로부터 불어오는 찬바람과 공기에 스프링클러가 노출됐기 때문”이라는 의견을 내고, “즉시 본사에 보고하고 피해보상과 복구를 하겠다”는 말을 하고 돌아갔다. 기자의 사실 확인 과정에서 아이에스동서의 S차장은 시공사의 책임을 인정하느냐는 질문에 “원인은 기술적인 부분이라 자기는 답할 수 없는 부분”이라며, “양측의 변호사가 법원에서 다툴 것”이라는 답변을 했다.
비니더스샵 측에서는 아이에스동서의 하자보수와 피해복구가 이루어지지 않자 1월 2일 ‘빠른 복구와 손해배상’을 요구하는 내용증명을 1차 발송 했다. 1월 8일 관할 소방서의 요구에 따라 스프링클러 배관을 교체하고 방화구획 마감 미처리 부분을 임시로 스티로폼으로 막았다. 그래도 바람이 들어와 확인해 보니 벽면에 바람이 들어오는 곳이 있어 건물 관리실에서 1월 9일 외부 바람 들어오는 곳을 막는 작업을 실시했다.

비니더스샵 측은 증거확보를 위해 스티로폼 작업 전, 벽면 막는 작업 전에 디지털 온도계를 설치하고 온도를 계측한 결과 외부온도 영하 8도일 때 스프링클러가 설치돼 있는 천장의 온도는 영하 5.6도이던 것이 스티로폼 작업과 벽면을 막는 작업 후 급격히 상승해 영상의 온도를 유지했다.
비니더스샵 측은 1월 11일 2차 내용증명을 발송해 하자보수공사 및 피해보상을 거듭 요청했다.
1월 11일 아이에스동서의 S차장과 비니더스샵 전재완 대표 간의 통화 녹취록에 따르면 아이에스동서의 S차장은 아이에스동서의 부실시공에 대해서 충분히 인지하고 있어서 피해금액이 2억 정도 발생했다고 상부에 보고하며 협의를 통한 배상을 건의했으나 본부장까지 보고하는 과정에서 협의를 통한 배상안은 배제되고, 법률소송을 통한 배상으로 가닥이 잡혔다는 취지로 발언했다. S차장은 그 이유를 피해금액이 크기 때문에 결재하는 사람 입장에서 1억이 넘는 돈을 결재하는 것은 회사 분위기 상 어려운 상태라며, 재판을 해서 재판부가 2억을 지급하라 하면 판결을 받은 거니까 결재하는 사람이 부담이 없다고 말했다.

안양시는 책임이 없는가?
비니더스샵 측이 1월 3일 안양시청에 민원을 접수하자 1월 8일 안양시청 건축과 직원 4명이 현장을 방문해 사고원인을 조사하고 그 중 한 사람이 사다리 끝까지 올라가 천장을 살펴보고 아이에스동서의 A/S센터장과 아이에스비즈타워 관리소장이 함께 있는 자리에서 방화구획 미처리 때문에 발생한 문제라고 말했다고 한다. 기자가 사실 확인 과정에서 안양시청 건축과를 방문해 발언내용에 대해 확인을 요청하자 천장까지 올라가 사고원인을 조사했던 안양시청 건축과 안전관리팀의 H 보좌관은 “‘방화구획 미처리 때문에 발생했을 수도 있다’고 말했다”고 답했다.
허가팀의 K 주무관은 감리과정에 대해서 “건축주가 선정한 시공감리자가 1차 감리완료보고서를 허가권자(지자체)에 제출하면 시는 업무대행자(특별검사원)을 선정, 현장조사를 하게 되고 현장조사 결과 문제가 없으면 사용승인을 하게 돼 있다”고 말했다. 건물에 하자가 발생하면 민원인이 경기도집합건물분쟁조정위원회에 ‘분쟁조정을 해달라’고 접수하고 분쟁조정위원회에서는 하자판정위원회에 하자의 내용을 확인하게 하며, 하자 판정 결과를 가지고 분쟁조정위원회에서는 하자의 보수, 보상 등을 결정하는 ‘분쟁조정’을 하게 된다.
